Karnataka HC Directs GBA Not to Evict KR Market Vendors for Now

The Karnataka High Court has directed the Greater Bengaluru Authority not to dispossess vendors operating in the open spaces of KR Market for now, provided they do not erect any temporary or permanent structures. The relief applies until the Street Vending Committee examines their pleas to accommodate them and issue vending certificates.
Justice BM Shyam Prasad passed the order on Wednesday while disposing of a petition filed by the Sri Krishna Rajendra Foot Path Vegetable and General Merchants Association.
The court stated that Greater Bengaluru Authority officials must ensure minimal obstruction to ingress, egress, and the open space around the quadrangle market. The court noted that authorities should manage access for vehicular movement, including fire extinguishing vehicles, ambulances, and loading and unloading vehicles, instead of evicting the petitioners completely before the Street Vending Committee completes its process.
During a previous hearing on August 6, the court had asked the Joint Commissioner of the Bengaluru City Central Corporation to submit a report on whether the association's members occupied any space within KR Market or on the footpath. The report was also meant to outline the circumstances under which the vendors could be relocated or asked to cease business if occupying footpath areas.
In response, the Assistant Revenue Officer, representing the Joint Commissioner, argued against the vendors' claims. The officer stated that none of the association's members held a Street Vending Certificate under the relevant law. The officer further contended that the petitioners occupied spaces and access routes intended for vehicular traffic and emergency services like ambulances and fire engines.
Counsel representing the vendors requested reasonable time for relocation rather than allowing an abrupt end to their livelihoods. Following the submissions, the court directed authorities to avoid taking precipitous eviction measures, while reminding the association members not to obstruct civic officials during critical situations.
