Jayanagar Dental Clinic Ordered to Pay Rs 23,000 to Patient After Failed Implants

The III additional Bengaluru Urban district consumer disputes redressal commission has ordered a dental clinic in Jayanagar to pay Rs 23,000 in compensation and refund to a 59-year-old resident of Thyagarajanagar. The ruling on May 21 followed two failed dental implant procedures and the unauthorized extraction of a supporting tooth that left the resident unable to chew.

The complainant, KN Srinivasa, first visited Partha Dental Clinic in Jayanagar in January 2023 to seek treatment for a damaged last-but-one molar tooth. He was advised to undergo dental implantation and paid an advance of Rs 29,000. Following preliminary diagnostic procedures on February 28, 2023, Srinivasa paid an additional Rs 8,000 on March 23 for a proposed prosthetic cap and zirconia crown.

In April 2023, the clinic performed the first implantation procedure, which failed. Srinivasa was advised to wait for the surgical site to heal before attempting a reimplantation. During the healing period from April to November 2023, he experienced continuous pain and damage to the adjacent tooth.

In November 2023, Srinivasa was advised to undergo a second implantation in February 2024. During this second procedure, the clinic extracted an adjacent supporting tooth that Srinivasa relied on for chewing food, without obtaining his consent. The second implantation also failed.

When the clinic advised a third implantation procedure, Srinivasa refused and requested a refund along with his medical records, which the clinic denied. Srinivasa secured an independent dental opinion on February 13, 2026, which confirmed that the failures were due to improper placement and negligent execution. He subsequently filed a consumer complaint on March 4, 2026.

Despite receiving notice, representatives from the Jayanagar clinic did not appear during the proceedings. The commission drew an adverse inference due to their absence. While Srinivasa sought a total refund of Rs 37,498 and Rs 10 lakh in compensation, the commission restricted the refund to Rs 8,000 because bills were only produced for Rs 8,498.

The commission bench ruled that the clinic's repeated failed procedures amounted to negligence. It ordered Rs 8,000 as a refund, Rs 5,000 for Srinivasa's suffering, and Rs 10,000 for litigation costs, bringing the total relief to Rs 23,000.
