Jayanagar Dental Clinic Ordered to Pay Rs 23,000 After Failed Implants

A 59-year-old resident has been awarded Rs 23,000 in compensation and refund by a consumer court after suffering from two failed dental implants at a clinic in Jayanagar, Bengaluru. The III additional Bengaluru Urban district consumer disputes redressal commission ruled in favor of the patient, KN Srinivasa, on May 21, following a dispute over negligent dental procedures that left him unable to chew.

Srinivasa, a resident of Thyagarajanagar, first visited the Partha Dental Clinic in Jayanagar in January 2023 to seek treatment for a damaged last-but-one molar tooth. He was advised to undergo dental implantation and paid an advance of Rs 29,000. Following preliminary diagnostic procedures in February 2023, he paid an additional Rs 8,000 in March 2023 for a proposed prosthetic cap and zirconia crown.

The first implantation procedure was conducted in April 2023 but ended in failure. Srinivasa was advised to let the surgical site heal before attempting a second procedure. During the healing period between April and November 2023, he suffered from continuous pain and damage to an adjacent tooth.

In November 2023, the clinic advised him to undergo a second implantation, which was scheduled for February 2024. During this second procedure, the clinic extracted an adjacent supporting tooth that Srinivasa relied on for chewing food, without obtaining his consent.

The second implantation also failed. When the clinic advised him to undergo a third implantation procedure, Srinivasa refused due to the repeated failures. He requested a refund and his medical records, but the clinic refused to provide them.

Srinivasa obtained an independent dental opinion on February 13, 2026, which confirmed that the implantation failures were caused by improper placement and negligent execution of the procedures. He filed a consumer complaint on March 4, 2026.

Despite being served notice by the commission, representatives from Partha Dental Clinic remained absent throughout the proceedings. This led the commission to draw an adverse inference against the clinic.

Srinivasa had claimed a total refund of Rs 37,498, along with Rs 10 lakh for medical negligence and Rs 50,000 for litigation costs. However, because he only produced payment receipts for Rs 8,498, the commission restricted the refund amount to Rs 8,000.

The commission ordered the Jayanagar clinic to pay Rs 8,000 as a refund, Rs 5,000 in compensation for the physical suffering Srinivasa underwent, and Rs 10,000 towards litigation costs, totaling Rs 23,000.
